{"id":61,"date":"2014-07-29T14:55:30","date_gmt":"2014-07-29T19:55:30","guid":{"rendered":"https:\/\/wwwtest.wisconsin.edu\/ohrwd\/benefits\/?page_id=61"},"modified":"2025-07-24T09:56:24","modified_gmt":"2025-07-24T14:56:24","slug":"dp","status":"publish","type":"page","link":"https:\/\/wwwtest.wisconsin.edu\/ohrwd\/benefits\/dp\/","title":{"rendered":"Domestic Partner Benefits"},"content":{"rendered":"<div id=\"toc\" class=\"uwsa-toc callout hidden-print\"><\/div><style>@media (min-width: 768px) {#toc { max-width: 50%} <\/style><script>jQuery(document).ready(function() {\n \t\t\t\t\tgenerateTOC(\"Domestic Partner Benefits\", \"\", \"div.entry-content\" ,1 ,\"true\", \"toc\");\n \t\t\t\t\t });<\/script>\n<h2><strong>Overview<\/strong><\/h2>\n<p>Universities of Wisconsin extends coverage to domestic partners and partner\u2019s children for the following plans:<\/p>\n<ul>\n<li><a href=\"https:\/\/wwwtest.wisconsin.edu\/ohrwd\/benefits\/dis-life-accident\/if\/\" target=\"_blank\" rel=\"noopener\">Individual &amp; Family Life Insurance<\/a>\u00a0and<\/li>\n<li><a href=\"https:\/\/wwwtest.wisconsin.edu\/ohrwd\/benefits\/dis-life-accident\/add\/\" target=\"_blank\" rel=\"noopener\">Accidental Death &amp; Dismemberment Insurance<\/a><\/li>\n<\/ul>\n<p>To cover your domestic partner and partner\u2019s children on these plans, you must create a domestic partnership for benefit purposes. Your partnership must meet the following requirements:<\/p>\n<ul>\n<li>You are both at least 18 years old and competent to enter into a contract; and<\/li>\n<li>Neither of you may be married to, or in a domestic partnership with another person; and<\/li>\n<li>Your partnership must not violate Wis. Stats. \u00a7765.03, which bars marriage between certain persons based on kinship and divorce; and<\/li>\n<li>You consider yourselves members of each other\u2019s immediate family; and<\/li>\n<li>You agree to be responsible for each other\u2019s basic living expenses; and<\/li>\n<li>You share a common residence \u2013 any of the following may apply:\n<ul>\n<li>One of you has legal ownership of the residence (if ownership is applicable); or<\/li>\n<li>One or both of you have additional residences not shared with the other partner; or<\/li>\n<li>One of you leaves the common residence with the intent to return.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>There are also leave benefits that allow you to take time off to care for a seriously ill domestic partner, their child, or their parent.<\/p>\n<p>See <a href=\"https:\/\/wwwtest.wisconsin.edu\/ohrwd\/benefits\/life-events\/famchng\/\" target=\"_blank\" rel=\"noopener\">Life Events Family Changes web page<\/a>\u00a0for how to add your domestic partner and partner\u2019s children to your benefits. This must be done within 30 days of establishing your domestic partnership.<\/p>\n<h2><strong>How to Create a Domestic Partnership<\/strong><\/h2>\n<p>Submit a Affidavit of Domestic Partnership (UWS 50) to your benefits contact to create a domestic partnership (form available in the Forms &amp; Resources section below). A Universities of Wisconsin domestic partnership cannot be established after the death of the employee or domestic partner.<\/p>\n<p><em><strong>The effective date of your Universities of Wisconsin Domestic Partnership is the date the affidavit is received by your Universities of Wisconsin benefits contact.<\/strong><\/em><\/p>\n<h2><strong>Leave Benefits<\/strong><\/h2>\n<h4><strong>Sick Leave<\/strong><\/h4>\n<p><span style=\"font-family: 'Arial',sans-serif\">You may use sick leave to care for a domestic partner and\/or your partner\u2019s children and\/or after the death of the domestic partner or your partner\u2019s children. See <\/span><a href=\"http:\/\/wwwtest.wisconsin.edu\/ohrwd\/benefits\/leave\/sick\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-family: 'Arial',sans-serif\">Sick Leave web page<\/span><\/a><span style=\"font-family: 'Arial',sans-serif\">\u00a0for details.<\/span><\/p>\n<h4><strong>Family &amp; Medical Leave<\/strong><\/h4>\n<p>See <a href=\"https:\/\/wwwtest.wisconsin.edu\/ohrwd\/benefits\/leave\/fmla\/\" target=\"_blank\" rel=\"noopener noreferrer\">Family and Medical Leave web page<\/a>\u00a0for information about the state and federal laws.<\/p>\n<p style=\"padding-left: 30px\"><strong>Wisconsin Family &amp; Medical Leave (WFMLA)<\/strong><\/p>\n<p style=\"padding-left: 30px\">Provides up to two weeks of job-protected leave per year to care for your domestic partner or your partner\u2019s parent who has a serious health condition.<\/p>\n<p style=\"padding-left: 30px\">Provides up to six weeks of job-protected leave within 16 weeks of birth or adoption of a domestic partner\u2019s child.<\/p>\n<p style=\"padding-left: 30px\"><strong>Federal Family &amp; Medical Leave (FMLA)<\/strong><\/p>\n<p style=\"padding-left: 30px\"><span style=\"font-family: 'Arial',sans-serif\">Provides up to twelve weeks of job-protected leave per year to care for your domestic partner\u2019s child with a serious health condition and\/or after the birth or adoption of your domestic partner\u2019s child.<\/span><\/p>\n<p style=\"padding-left: 30px\"><span style=\"font-family: 'Arial',sans-serif\">You must have an <em>in loco parentis<\/em> relationship to your partner\u2019s child. You stand <em>in loco parentis<\/em> to a child if you have day-to-day responsibilities relative to the child \u2013 no biological or legal relationship to the child is required.<\/span><\/p>\n<h2><strong><a id=\"end-dp\"><\/a>How to End a Domestic Partnership<\/strong><\/h2>\n<p>Submit a Affidavit of Domestic Partnership (UWS 50) to your benefits contact within 30 days of the end of your domestic partnership (available in the Forms &amp; Resources section below).<\/p>\n<ul>\n<li>The domestic partnership ends as of the date your benefits contact receives the affidavit.<\/li>\n<li>It is the responsibility of the domestic partner submitting the affidavit to notify the other domestic partner that they are terminating the domestic partnership.<\/li>\n<li>The termination of the Universities of Wisconsin Domestic Partnership is irrevocable.<\/li>\n<li>Once a Affidavit of Termination of Domestic Partnership (UWS 50) is filed, you cannot enroll a different domestic partner under any benefit plans for at least 6 months.<\/li>\n<li>Coverage for your former domestic partner and their children end at the end of the month in which the domestic partnership was terminated. However, you will need to remove them from your benefit plans. For more information, refer to <a href=\"https:\/\/wwwtest.wisconsin.edu\/ohrwd\/benefits\/life-events\/famchng\/\" target=\"_blank\" rel=\"noopener\">Life Events Family Changes web page<\/a>.<\/li>\n<li>Update your beneficiary designations (if necessary).
